TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to www.blackoakmagick.com and your use of the content, products, digital materials, and services offered by Black Oak Magick (“Black Oak Magick,” “we,” “us,” or “our”).

By accessing the website, placing an order, downloading a product, or purchasing or booking a service, you agree to these Terms. If you do not agree, please do not use the website or make a purchase.

  1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase from Black Oak Magick or use its paid services.

By using the website or completing a purchase, you represent that you meet this requirement.

  1. Website Information

We make reasonable efforts to keep website information accurate and current. However, typographical errors, technical errors, outdated information, or temporary inaccuracies may occur.

We may correct errors, update information, or cancel an affected order when reasonably necessary. If we cancel a paid order, we will refund the amount charged for the canceled item or service.

  1. Products and Natural Variation

Many Black Oak Magick products are handmade, vintage, natural, one-of-a-kind, intuitively selected, or produced in small quantities.

Colors, textures, mineral formations, wood grain, patina, packaging, placement, and other details may vary. Computer and mobile screens may also display colors differently.

Vintage and previously owned merchandise may show age-appropriate wear. Material flaws or condition issues known to us will be disclosed in the listing whenever reasonably possible.

Natural variation, disclosed vintage wear, and minor differences that do not materially change an item are not considered defects.

  1. Intuitively Selected Products

Some listings may state that Black Oak Magick will intuitively select the specific color, stone, shape, style, or variation sent to the customer.

By purchasing such an item, you acknowledge that you are purchasing from the described assortment and are authorizing Black Oak Magick to choose the individual piece. A preference may be requested, but fulfillment of that preference is not guaranteed unless we confirm it in writing.

  1. Orders and Acceptance

Submitting an order does not guarantee acceptance. We may decline or cancel an order because of:

• Product unavailability
• Pricing or listing errors
• Suspected fraud or unauthorized payment
• Shipping restrictions
• An inability to fulfill the order safely or lawfully
• Abusive, threatening, or inappropriate customer conduct

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion.

Products are subject to availability. We may impose reasonable purchase limits or discontinue an item without notice.

  1. Prices, Payments, and Taxes

Prices are displayed in the currency identified at checkout and may change without notice.

You agree to provide accurate, current, and complete billing, payment, and contact information. Payments are processed through the payment methods offered at checkout.

Applicable sales tax, shipping costs, duties, import taxes, and other charges will be displayed or assessed as described during checkout and in our Shipping Policy.

Canadian customers are responsible for customs duties, import taxes, brokerage charges, and other government fees not collected at checkout.

  1. Shipping

Black Oak Magick currently ships physical merchandise only within the United States and to Canada.

Processing and delivery estimates are not guarantees. Shipping practices, address requirements, customs information, and procedures for delayed, damaged, missing, or returned packages are explained in our Shipping Policy.

If we cannot ship within the promised time, we may contact you to obtain consent to a delay or provide the option to cancel the unshipped merchandise for a refund, as required by law.

  1. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy.

Certain categories are final sale, including digital downloads, completed services, personalized goods, print-on-demand merchandise, hygiene-sensitive goods, and products specifically marked “Final Sale,” except where the item is defective, materially misdescribed, incorrect, or applicable law requires another remedy.

Nothing in these Terms removes a consumer right that cannot legally be waived.

  1. Digital Products

A purchase of a digital product grants you a limited, revocable, nonexclusive, nontransferable license for your own personal, noncommercial use.

Unless a product license expressly states otherwise, you may not:

• Resell, redistribute, sublicense, or share the file
• Upload it to a shared drive, membership library, marketplace, or public website
• Modify it for resale
• Claim it as your own work
• Use it to train an artificial-intelligence system or build a competing database or product
• Remove copyright, attribution, or proprietary notices

Purchase does not transfer copyright or ownership.

Digital products are generally final sale once access or download delivery has been provided, except where required by law or when the file is materially defective and we cannot provide a working replacement.

  1. Appointments and Spiritual Services

Service descriptions explain the format, deliverables, and approximate timing associated with each offering.

You are responsible for providing accurate information and participating appropriately. We may refuse or discontinue a service if a request is unlawful, unsafe, abusive, outside our scope, or inappropriate for a spiritual service.

Appointments require at least 24 hours’ notice to cancel or reschedule. Late cancellations and no-shows may be nonrefundable. Custom reports and other prepared services become nonrefundable once substantive preparation or performance has begun.

  1. Spiritual and Wellness Disclaimer

Black Oak Magick’s spiritual services, educational materials, and metaphysical product descriptions are not medical, mental-health, veterinary, legal, financial, or other licensed professional advice.

Reiki and related energy practices are complementary wellness practices and are not substitutes for diagnosis or treatment from a licensed healthcare professional.

Divination, tarot, oracle, palmistry, and dream interpretation are offered for spiritual exploration, entertainment, education, and personal reflection. No outcome, prediction, manifestation, healing result, or life change is guaranteed.

Your decisions remain your own responsibility. Please review our full Disclaimer before purchasing or using spiritual content, products, or services.

  1. Product Safety

You agree to read product descriptions, ingredient information, warnings, and instructions before use.

Never leave a burning candle unattended. Keep flames, oils, crystals, jewelry, small objects, herbs, packaging, and ritual materials away from children and pets when they could present a fire, choking, ingestion, allergy, or other safety hazard.

Body or aromatic products should be used only as directed. Perform an appropriate patch test before applying a new topical product. Discontinue use if irritation develops. Do not ingest a product unless it is expressly identified and legally sold for ingestion.

Black Oak Magick is not responsible for injury or property damage caused by ignoring supplied warnings, altering a product, using it for an unintended purpose, or continuing use after a known adverse reaction.

  1. Intellectual Property

Unless otherwise stated, the website and its original content—including text, articles, illustrations, photographs, graphics, logos, brand names, downloads, product designs, and arrangement—belong to Black Oak Magick or are used under license.

You may view the website for personal, noncommercial purposes. You may not reproduce, republish, distribute, sell, scrape, modify, or commercially exploit protected content without prior written permission.

“Black Oak Magick,” its branch identities, and associated artwork may be protected by applicable trademark, copyright, and unfair-competition laws.

  1. Permitted Conduct

You may not:

• Use the website for fraud, unlawful activity, harassment, or abuse
• Attempt to access accounts, systems, or information without authorization
• Introduce malware or interfere with website operation
• Scrape, harvest, or systematically copy website content
• Impersonate another person or submit false information
• Infringe intellectual-property or privacy rights
• Use website content to build a competing commercial product or service

We may restrict access or refuse service when reasonably necessary to protect the business, customers, or website.

  1. Reviews and User-Submitted Content

If you submit a review, photograph, testimonial, comment, or other material for public use, you represent that you have the right to submit it and that it is truthful and lawful.

We will not publicly use private service details or identifying information as a testimonial without permission.

When you expressly authorize content for publication, you grant Black Oak Magick a nonexclusive, royalty-free license to display and reproduce that content for the authorized purpose. You may withdraw permission for future use by contacting us, although previously printed materials may not be recoverable.

  1. Third-Party Services and Links

The website may contain links to or integrations with third-party websites and services. We do not control their content, security, availability, terms, or privacy practices.

Your use of a third-party service is governed by that provider’s terms and policies.

  1. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis without warranties regarding uninterrupted availability, perfect accuracy, spiritual results, or suitability for a particular purpose.

This section does not exclude warranties, guarantees, or consumer rights that cannot lawfully be excluded.

  1. Limitation of Liability

To the fullest extent permitted by law, Black Oak Magick will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the website, content, products, or services.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, personal injury caused by negligence where such limitation is prohibited, or another liability that cannot legally be limited.

  1. Indemnification

To the extent permitted by law, you agree to reimburse Black Oak Magick for reasonable losses, claims, or expenses arising from your unlawful misuse of the website, infringement of another person’s rights, or material violation of these Terms.

This provision does not apply to claims caused by Black Oak Magick’s own unlawful conduct or where such an obligation is prohibited by consumer law.

  1. Governing Law

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.

Any dispute not resolved informally may be brought in a court of competent jurisdiction in California, unless the consumer-protection laws of your home jurisdiction give you a nonwaivable right to bring a claim elsewhere.

Canadian and other consumers retain all mandatory rights provided by applicable local law.

  1. Changes to These Terms

We may update these Terms as the website, offerings, or legal requirements change. Updated Terms will be posted with a revised “Last Updated” date.

Changes will apply prospectively unless applicable law permits otherwise.

  1. Severability and No Waiver

If any portion of these Terms is found unenforceable, the remaining provisions will continue to the extent legally permitted.

A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

  1. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy, Disclaimer, and any product- or service-specific terms presented at purchase, constitute the agreement governing your use of the website and purchases.
